INFORMATION ON THE PROCESSING OF PERSONAL DATA

Data Controller

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR), please be informed that:

  3. Your personal data obtained during the provision of services, the conclusion of contracts, and during their term or performance, are used for the following purposes:
    • concluding and performing a contract for the provision of services offered by the Data Controller, and providing these services in accordance with the concluded contract; legal basis: Article 6(1)(b) of the GDPR;
    • fulfilling the legal obligations incumbent on the Data Controller (e.g. issuing and storing invoices and other accounting documents, making data available to authorised entities, courts, prosecutors, the Police); legal basis: Article 6(1)(c) of the GDPR;
    • pursuing potential claims arising from the non-performance or improper performance of the concluded contract for the provision of services, or any other claims arising from applicable law; legal basis: Article 6(1)(f) of the GDPR;
    • marketing and promoting all services provided by the Data Controller; legal basis: explicit consent to the processing of data for marketing and promotional purposes, Article 6(1)(a) of the GDPR.
  4. Your personal data will be stored for the duration of the service agreement and, after its termination, for the period necessary to fully settle the services provided and the obligations arising from the agreement, until the expiry of the limitation period for claims arising from that agreement, as specified by the applicable laws, whether such claims are held by the service provider (the Data Controller) or by the service recipient. For tax settlement purposes, personal data will be stored for the period required under the applicable tax law, i.e. for the limitation period for tax liabilities (currently 5 years from the end of the tax year in which the obligation to pay tax in connection with the services provided to you arose). Where the processing is based on consent, personal data will be processed until such consent is withdrawn by the data subject.
  5. Access to the data will be granted to individuals collaborating with the Data Controller in the provision of services to you, including those providing legal and financial services to the Data Controller. In cases strictly defined by law, your data will have to be transferred to authorised authorities, in particular the Police or the prosecutor’s office.
  6. The Data Controller does not intend to transfer your data outside the European Economic Area (EEA).
  7. Rights of the data subject.

    Please be informed that you have the following rights regarding your personal data:
    • right of access, i.e. to obtain information on whether the Data Controller processes your data, and if so, to what extent;
    • right to rectification of personal data, if you believe they are incorrect or incomplete;
    • right to restriction of processing, i.e. to request the retention of data collected so far by the Data Controller and to suspend further data operations, except for their storage;
    • right to erasure of data (‘right to be forgotten’) in situations listed in Article 17(1) of the GDPR;
    • right to data portability, i.e. to have the data transmitted to another data controller or directly to you;
    • Processing of data based on explicit consent.

      If the data processing is based on your explicit consent, you have the right to withdraw this consent at any time, provided that the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

  8. Right to object to data processing.
    You also have the right to object at any time:
    • to the processing of your personal data for direct marketing purposes.
      Upon raising such an objection, the Data Controller will no longer be permitted to process your personal data for such purposes;
    • on grounds relating to your particular situation – to the processing of data carried out for the purposes of the legitimate interests pursued by the Data Controller Upon raising such an objection, the Data Controller will no longer be able to process your personal data for such purposes, unless the Controller demonstrates compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defence of legal claims.
  9. You have the right to lodge a complaint with a supervisory authority, which is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), if you believe that the processing of your personal data by the Data Controller violates the law.
  10. Your data will be subject to standard and automated profiling solely for the purposes of concluding a contract and providing services to you by the Data Controller.

Google Analytics

  1. The BanGlob Catering website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.
  2. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.
